Effective October 25, 2026 · Version 2026-10-25
These Terms of Sale ("Terms") govern every purchase of data from Revvy ("Revvy," "we," "us") by you, the purchaser ("Buyer," "you"). By checking the acceptance box and completing a purchase, you agree to these Terms on behalf of yourself and any business you represent.
1. The product
Revvy sells consumer contact records ("Leads") related to health insurance and fixed benefit indemnity coverage. Leads come from consumers who submitted opt-in forms on Revvy web pages or partner sites. Revvy offers one data set. Leads are sold for the states the Buyer selects at checkout.
2. Pricing and payment
- Leads are priced at $0.30 (USD) per Lead.
- The minimum order is 1,000 Leads.
- Payment is due in full at checkout and is processed by Stripe. Orders are not fulfilled until payment is confirmed.
- Prices may change at any time, but changes do not affect orders already paid.
3. Delivery
Leads are delivered electronically to the email address provided at checkout within 24 hours after payment is confirmed. You are responsible for providing an accurate email address and for keeping delivered files secure. Delivery is complete when the file is sent to that address.
4. All sales final, no refunds
Because data cannot be returned once delivered, all sales are final. Revvy does not offer refunds, credits, or exchanges for any reason, including contact rates, conversion rates, consumer responsiveness, duplicate records, disconnected numbers, or a change of mind. Revvy may, at its sole discretion and without obligation, replace records it determines to be invalid.
You agree not to initiate a chargeback or payment dispute for an order delivered under these Terms. If you do, Revvy may submit your order records, acknowledgment timestamps, IP address, and delivery confirmation to the payment processor, refuse future orders, and pursue recovery of the amount disputed plus any fees and costs.
5. Consent terms
Leads were collected through web forms that included consent language presented to the consumer at the time of submission. Revvy will make the consent language and available submission details for a Lead available on reasonable written request.
You are solely responsible for determining whether the consent obtained is sufficient for the specific way you intend to contact each consumer, including by phone call, text message, prerecorded or artificial voice, automated dialing system, or email, under all applicable laws. Revvy makes no representation that any consent satisfies the requirements of any particular law for any particular contact method used by you.
If a consumer revokes consent or asks not to be contacted, you must stop contacting that consumer promptly and within the time required by law. Revvy may forward consumer opt-out requests to you, and you must honor them.
6. Permitted use
You may use Leads only to market health insurance and fixed benefit indemnity products, through yourself and your own licensed agents, to the consumers in the Leads. You may not:
- resell, rent, share, sublicense, transfer, or give Leads to any third party;
- use Leads to market any product or service other than health insurance and fixed benefit indemnity;
- use Leads for any unlawful, deceptive, harassing, or abusive purpose;
- contact consumers in states where you or your agents are not properly licensed;
- misrepresent your identity, the nature of a product, or your relationship with Revvy or any insurance carrier.
7. Major medical acknowledgment
By purchasing, you represent and warrant that you and every agent who contacts a consumer from your Leads are licensed and able to offer major medical health insurance in each state you selected. You agree to present major medical coverage to each consumer before offering any fixed benefit indemnity product, and to clearly disclose that fixed benefit indemnity is not major medical insurance and is not a substitute for comprehensive health coverage.
8. Buyer's sole responsibility for compliance
Once delivered, you are solely responsible for how Leads are used and for complying with all applicable federal, state, and local laws, regulations, and rules, including but not limited to the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the National Do Not Call Registry, state telemarketing and "mini-TCPA" laws (such as the Florida Telephone Solicitation Act), CAN-SPAM, state insurance marketing and licensing laws, and, where applicable, federal health insurance marketing rules. This includes scrubbing Leads against federal, state, and internal Do Not Call lists, observing calling-hour and frequency limits, and keeping your own records of compliance.
9. Indemnification
You agree to defend, indemnify, and hold harmless Revvy and its owners, officers, employees, and partners from and against any claims, lawsuits, regulatory actions, damages, fines, penalties, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your purchase or use of Leads, your contact with any consumer, your breach of these Terms, or your violation of any law.
10. Data security
You must protect Leads with reasonable security measures, limit access to people who need it to perform permitted uses, and notify Revvy promptly of any unauthorized access to or disclosure of Leads. On Revvy's written request, you must delete any Lead associated with a consumer request to delete their information.
11. Disclaimers
Leads are provided "as is" and "as available." Revvy makes no warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, contactability, or results. Revvy does not guarantee any number of contacts, appointments, sales, or revenue.
12. Limitation of liability
To the fullest extent permitted by law, Revvy's total liability for any claim arising out of or relating to these Terms or any order will not exceed the amount you paid for that order. Revvy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue.
13. Refusal and termination
Revvy may refuse or cancel any order before delivery for any reason, including suspected fraud or misuse. If an order is canceled before delivery, Revvy will return the payment for that order. Revvy may refuse future orders from any Buyer who violates these Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
15. General
These Terms, together with the Privacy Policy and the acknowledgments you make at checkout, are the entire agreement between you and Revvy about your purchase. If any part is found unenforceable, the rest remains in effect. Revvy may update these Terms for future orders. The version in effect when you place an order applies to that order.
